The study sample consisted of (30) female teachers of the basic stage in the Directorate of Education of the Naour District, who teach Arabic language, Islamic education and science. The results of the study showed that there were statistically significant differences in the estimates of the members of the two groups (experimental and control) in the post application of the scale of teaching performance skills among the teachers of the basic stage in the Naour District for favor of the teachers who were trained by using the training program based on habits of mind and there were statistically significant differences between the averages of the estimates of the members of the two groups (experimental and control) in the post application on the dimensions of teaching performance skills represented by (education professionalism, teaching planning, teaching implementation, time management, mastery of scientific material, and modern evaluation methods) in favor of the experimental group attributed to the training program based on habits of mind. * A PhD thesis titled “Claims about preferring between Conflicting Ahadith in Purity and Prayer Chapteres, an Usuli Jurstic Study"
By : Ali Mahmoud Saleh Dradkeh
Supervisor : Mansour Meqdadi 2024
ABSTRACT: This study addressed the claims of preference between apparently contradictory hadiths in the chapters of purity and prayer, by explaining the meaning of contradiction and preference, their realities, their pillars, their conditions, their scope, and by explaining the methods of scholars in resolving the apparent contradiction between the evidences. It then applied this to jurisprudential issues in the chapters of purity and prayer. To achieve the study's objectives, the researcher followed the inductive deductive approach, which involves explaining the concept of contradiction and preference, their realities, pillars, conditions, and scope, and applying them to issues in the chapters of purity and prayer. The study found the importance of the science of the principles of jurisprudence in explaining ways to resolve the apparent contradiction between legal evidences, and that contradiction only occurs in the mind of the mujtahid (jurist), while true contradiction does not exist at all, as that would imply a deficiency in the Lawgiver, which is exalted above that. Given the importance of this topic, this scientific study came as an attempt to prove that the contradiction between evidences is only apparent and in the mind of the mujtahid, and to identify the methods 261 scholars use to resolve this apparent contradiction, the disagreement between them in the order of these methods and approaches used by mujtahdids, and to ward off the claim of preference that some scholars have taken when dealing with apparently contradictory legal evidences, since it is possible to reconcile between them and act upon them all, which is in accordance with the original purpose for which the evidence was established, which is to act upon it, rather than abandoning the evidence, contrary to the principle of (employing two evidences is better than neglecting one of them). The study addressed some issues in the chapters of purity. And prayer as jurisprudential applications to demonstrate the ways of the scholars in resolving apparent contradictions, and highlighting the approach of reconciliation and combining the seemingly contradictory evidence. Keywords: contradiction, resolution, reconciliatory resolution, combination .
* A PhD Thesis Titled “Text Based On Custom Its Concept, Peers, Waysd Of Revealing It, And Its Impact On Changing The Legal Rulings Fundamental Practical Study"
By: Huseyin Sudan
Supervisor: Mansour Meqdadi 2024
ABSTRACT Rationalisation of the text by the custom existing at the time of legislation makes the change in custom have an impact on the change in the Sharīᶜah ruling. Knowing this contributes to the process of contemporary ijtihād and understanding texts correctly, and ignoring it leads to moving away from the objectives of Sharīᶜah. Accordingly, the study addressed the concept of the text based on custom, the proofs for it, the position of uṣūl scholars towards it, its relationship to uṣūl topics, the methods and indications that are used to identify it, and its applications in devotional matters and transactions. The study reached several results, including: that the concept of the text based on custom refers to the rationalisation of the text by custom or by customary cause; and that changing the ruling in the text according to the new custom is not a contradiction to the text but rather a change to the ruling due to its cause's change. This is not an opinion that was unique to Abū Yūsuf. This change may be in the manner of ruling, not in its essence, and it may be partial in the specification by custom. It is also concluded that the way of identifying the text based on custom is to follow the occasions and circumstances for revelation, the narrations, and the circumstances for the revelation of ḥadīth, so the text may be limited to its cause for the presumption of custom. The study also confirmed that the indications of the text based on custom are that it is rationalised and related to rulings on means and partial rulings. The text will not be identified as the text based on custom in rulings on devotional matters, general rulings, and the rulings on objectives of Sharīᶜah. The study revealed that the subjects of transactions are the ones most subject to customary rationalisation, but some rulings on devotional matters can also be rationalised by custo

* A Master Dissertation Titled “ The Impact Of The Meanings Of The Words In The Hanafea On The Purposes Of The Law"
By: Abdulsalam Fayez AL Mahasneh
Supervisor: Mansour Meqdadi 2019
ABSTRACT This study investigates the relationship between Almaqasid (intentions and objectives) of Islamic Sharia'h with the denotation of expressions and utterances according to AL HANAFIYAH. This study shows that the denotation of expressions has a significant effect on implementing the objectives, and that it is a way to apply the provisions. This relationship isn’t known to many people. Thus, it needs clarification and explanation. Accordingly, the study investigates the relationship between Almaqasid of Islamic Sharia'h with the orders, the prohibition and the general. It also investigates the relationship between the utterance according to its apparent meaning and the embedded one with Almaqasid of Islamic Sharia'h. This relationship is divided into four overt categories: the apparent, the context, the paraphrased, and the concise as well as four covert ones: the implicit, the ambiguous, the concise, and the similar. It further investigates the four categories of the utterance in expressing the meaning with Almaqasid. These categories involve: the expression, the sign, the text, and the ALEGTEDHA’ (connotation). Moreover, it tackles the relationship between the utterance according to how it uses the meaning whether it is factual or metaphorical with Almaqasid. However, the study has followed the inductive approach and the analytical one. The study has revealed that Almaqasid control the new occurrences and they constitute the origin to which we refer when there are several provisions dealing with one incident. The study concludes that the relationship between Almaqasid and the denoting meaning of expressions are controlled by the general and the specific. The study has depicted some practical evidences in each chapter that show how Almaqasid are formulated through these indicator provisions and how these provisions, when applied to the auditory evidences, form the legal position of Almaqasid theory.
